A16z Crypto Backs CLARITY Act After Senate Committee Vote
The committee’s “markup” vote moved the legislation forward on a bipartisan basis. Miles Jennings, General Counsel and Head of Policy at A16z Crypto, called it a historic milestone for the industry. The bill now heads toward a full Senate floor vote, where both the Senate Banking Committee version and the Senate Agriculture Committee’s companion portion will be merged into one unified package.
If the combined bill clears the full Senate, it goes to the House for approval. A House version of the CLARITY Act, designated HR 3633, passed in July 2025 with 294 votes in favor and 134 opposed, including 78 Democrats. A signature from the president would make it law.
The CLARITY Act draws from years of legislative groundwork. Senators Lummis and Gillibrand introduced the first bipartisan framework in June 2022. The earlier Financial Innovation and Technology for the 21st Century Act, known as FIT21, cleared the House in 2024 with 279 votes, including 71 Democrats. Each round built momentum that pushed the Senate to accelerate its own drafts through late 2025 and into 2026.
A core problem the legislation targets is the absence of clear boundaries between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). Without a defined jurisdiction, builders have faced shifting enforcement interpretations for years. Jennings described the current approach as “regulation-by-enforcement” that created openings for bad actors while penalizing responsible developers.
The CLARITY Act aims to define when a digital asset is a security and when it is a commodity. It also establishes oversight rules for crypto exchanges and adds consumer protections for digital asset trading, areas where existing law offered little specific guidance.
Jennings drew a sharp distinction between companies and blockchain networks. Companies operate through centralized control. Networks, by design, coordinate participants through shared rules with no single controlling party. When corporate legal frameworks are applied to networks, he argued, intermediaries emerge and capture value that would otherwise flow to users.
That dynamic already defines much of the digital economy. A16z Crypto points to ride-sharing and music streaming as examples where platform operators collect the majority of revenue while the people generating value receive a fraction of it.
Blockchain networks, Jennings wrote, offer a different structure: infrastructure governed by transparent rules, owned and operated by participants, where value can reach the edges of the network rather than concentrate at the center.
The GENIUS Act, which created a regulatory framework for stablecoins and passed in July 2025, provided a working example of what crypto-specific legislation can unlock. Jennings said its passage led to measurable adoption gains and positioned stablecoins inside mainstream applications, including integrations with AI agents.
Jennings framed the global stakes plainly. The European Union’s MiCA regulation and the United Kingdom’s crypto rules are already ahead of the U.S. in offering defined frameworks. No competing jurisdiction has built an ideal regime yet, but he warned that calibrated rules elsewhere will eventually pull startup activity, capital, and jobs out of the United States.
The CLARITY Act is designed to prevent that outcome by giving builders a legal basis to launch blockchain networks domestically, raise capital inside U.S. borders, and operate without the structural compromises that regulatory uncertainty has forced on them for more than a decade.
A16z Crypto said it will publish a more detailed breakdown of what CLARITY does and does not cover for builders once the bill advances to the Senate floor and any final amendments are made.
